Disabled student made false claim, IIT-D tells court

The Indian Institute of Technology-Delhi (IIT-D) informed the Delhi High Court that before denying admission to a disabled student, its medical board found his claim on the degree of his handicap to be false.
The institute said that the student, who moved the court after rejection of his application this year, participated in the medical examination before the board and was found to have 18 percent permanent disability instead of 40 percent as claimed by him.
Amit Kumar from Bihar challenged the decision of IIT-D denying him admission under the handicapped category on the ground that his disability was less than 40 percent as claimed by him.
"The medical board of IIT-Joint Entrance Examination 2012, which examined the petitioner on June 5 found only 18 percent permanent disability," said IIT-D.
"The medical Board concluded that he did not qualify for the physical disability quota as the requirement of having at least 40 percent disability was not met," IIT-D said in its reply.
The institute countered the claim of Amit Kumar based on a certificate issued by Bihar hospital and said the certificate was issued in 2005 and the doctors had opined that his condition would improve after an operation was done.
The institute also alleged that the Bihar government had not authorised the hospital in Darbhanga to issue any disability certificate.
Justice G.S. Sistani asked petitioner's advocate Ashok Aggarwal to submit if any authorisation letter was issued by the state government to the hospital.
The court would next hear the case on July 12.
